BOISE, Idaho (KMVT/KSVT) — Attorneys for Thomas Creech, who is scheduled to be executed on Wednesday, are asking the court to review what they claim to be false evidence that was presented by the state at his clemency hearing in Boise, this according to KBOI.

His attorneys claim that prosecutors showed a PowerPoint presentation with a picture of a sock with Creech’s name on it during the clemency hearing on Jan. 19.

According to the attorneys, the sock was next to a much longer sock that appeared to be a larger size. The picture was accompanied by text that said: “Mr. Creech said, there were names on all the socks, the weapon was labeled Garza.”

Creech’s attorneys claim the prosecution then insinuated to the Commission of Pardons and Parole that the murder weapon was Creech’s and not Garza’s, though Creech had claimed that the sock was Garza’s.

Creech’s attorneys claim that the prosecutors most recently presented this evidence to a three-judge panel of the Ninth Circuit Court of Appeal on Saturday where one of the judges questioned the validity of the evidence and whether the evidence had anything to do with the case.

Creech’s attorneys are asking for a full review by the full 9th Circuit Court judicial bench.
