Audio of Tammy Daybell’s 911 call played in court again
BOISE, Idaho (KMVT/KSVT) — Thursday morning in the murder trial of Chad Daybell, defense attorney John Prior revisits the night Tammy Daybell called 911 to report a possible shooting.
Daybell’s attorney is trying to convince the jury that the gun that was allegedly used by who they assume was Alex Cox was a paintball gun and not a rifle as the state asserts.
When listening to the 911 call Tammy refers to the weapon as both a paintball gun and a rifle when talking to the dispatcher.
Dispatcher: Fremont County Sheriff’s Office.
Tammy: Hi, I need to report something.
Dispatcher: Ok. Go ahead, what is the address?
Tammy: Ok.. um.. 202 North 1900 East. The corner with the broken yellow light on the highway.
Dispatcher: Is there a suspicious person?
Tammy: Yes.
Dispatcher: Ok. What was she wearing?
Tammy: He was all dressed in black, and he had a ski mask on.
Dispatcher: And you said at the blinking yellow light is where you saw him?
Tammy: No. No. I’m when I - He is gone now. Cause, um... I pulled up into our driveway and he - I was getting stuff out of the back seat of my car and suddenly he was there, and he had a paintball gun, like he was going to shoot at me. And I kept asking him what he was doing, so I could tell it was a paintball thing.
Dispatcher: ok
Tammy: And then he just kept doing it, so I yelled for my husband, and then he took off running around the back of my house.
Dispatcher: Ok just give me one minute and stay on the line with me.
In more of the call, Tammy also calls the weapon the person dressed in black a rifle and a gun. And testimony from Detective Kaaiakamanu details research Tammy did online of pictures of paintball guns and testified that it was not known what kind of knowledge she had of guns in general.
Chad Daybell is charged with three counts of first-degree murder in the death of his first wife Tammy Daybell, and the deaths of his current wife, Lori Vallow Daybell, and two children Tylee Ryan and J.J. Vallow. Along with charges of grand theft and conspiracy to commit murder.
The murder trial is expected to wrap up in mid-June; if convicted he could face the death penalty.
