Boudreaux testifies on the attempt to kill him in Daybell’s murder trial
BOISE, Idaho (KMVT/KSVT) — The ex-husband of Lori Vallow Daybell’s niece took the stand Tuesday in Chad Daybell’s murder trial that continues at the Ada County Courthouse in Boise.
Brandon Boudreaux talked about his relationship with his ex-wife Melanie, he spoke about how he was the one to baptize Tylee Ryan into the LDS faith.
He also testified about how Melanie was easily influenced by Lori Vallow Daybell and that Lori took care of Melanie too.
Boudreaux also spoke about the Day on October 2, 2019, when someone shot at him in an attempt to take his life as he was on his way home from the gym.
Prosecutor Rob Wood: So you notice the Jeep?
Boudreaux: Mmmhmm
Wood: Did you notice anybody inside of it?
Boudreaux: I couldn’t tell if there was anybody inside of it. You know that happened in.. in such.. I mean imagine coming around the corner driving a couple house lengths. It all happened very quickly. And then the window... uh... opened up and I saw a gun and uh a silencer and um... I was uhh... I mean... My window shattered, I heard a bang, you know all in the same amount of time. And my immediate thought was that I’m being shot at. And I... instead of turning my wheel into my driveway I just pushed I just pushed the gas and drove straight.
Also on the stand Tuesday was Fremont County Sheriff Deputy Colter Cannon, he was on patrol the night that Tammy Daybell called 911 to report a gun incident. Tammy reported to officers that the man was holding the gun like a rifle and shot, but nothing was fired.
Audio of the 911 call was played for the court several times.
Cannon testified that Tammy confronted the gunman and that Chad would have heard the entire conversation. The deputy found it odd that Chad never took any protective actions to protect his wife.
Defense attorney John Prior pushed the point with Cannon that the gun that Tammy saw could have been a paintball gun, however, the deputy would not concede that the gun Tammy reportedly saw was a paintball gun, when she noted the man held it like a rifle.
Chad Daybell is charged with three counts of first-degree murder for the deaths of Tammy Daybell, Chad’s first wife, and the deaths of Lori Vallow Daybells two children 16-year-old Tylee Ryan and 7-year-old J.J. Vallow. Chad is also facing grand theft and insurance fraud charges. If convicted he could face the death penalty.
Lori Vallow Daybell was convicted by a jury last year in the same courtroom that Chad is being tried in, Judge Steven Boyce sentenced her to multiple life sentences without the possibility of parole, lawyers representing her have filed an appeal. She was extradited to Arizona where she faces two counts of conspiracy to commit murder in relation to her fourth husband, Charles Vallow, and former nephew-in-law, Brandon Boudreaux.
Vallow Daybell has a scheduling conference for April 24 and the judge in the case granted Daybell’s request to waive her presence at the hearing. Her trial is set to begin on August 1 of this year, but due to the 20 terabytes of computer data, the judge noted that the trial may be pushed to a later date.
