The prosecution moves forward in calling more witnesses in the murder trial of Chad Daybell

BOISE, Idaho (KMVT/KSVT) — **UPDATE: 5 p.m.**

Rexburg Police Department Lt. Powell was called to the stand, Defense Attorney John Prior questions Powell at length about the death of Tammy Daybell and whether Tammy’s children were notified about exhuming her body.

“So her whole family was never advised that you were digging their mother up out of the ground without any shape, form, or opportunity to respond, is that right?”

“Yes.” Powell testified.

Prior asked if Powell is aware that Chad has not been implicated in the murder of Charles Vallow and the attempted murder of Brandon Boudreaux. Powell says he’s aware.

Prior said he asked this question because of these other deaths; how does that give Powell the right to dig up Tammy Daybell? Powell says it’s because of all the other information related to this case.

Powell was released from the stand and the state then called FBI Tactical Specialist Nicole Heidemann, to testify about the 9 cell phones tied to Chad Daybell and Lori Vallow Daybell, however since time was running short, court adjourned at 3:30 p.m. and will pick up again Tuesday morning at 8:30 a.m.

Chad Daybell is charged with three counts of first-degree murder, conspiracy to commit murder, grand theft, and insurance fraud. If convicted, he could face the death penalty.

The trial is being web streamed daily via Judge Steven Boyce’s YouTube channel.

The murder trial of Chad Daybell resumed Monday morning at the Ada County Courthouse in Boise.

Last week, jurors heard from one witness, Det. Hermosillo of Rexburg Police Department, he took the stand to describe his involvement with the Daybell investigation, and described how his team found the bodies of Tylee Ryan and JJ Vallow on Chad Daybell’s property.

This week, the state will be calling more witnesses, as the capital murder trial moves forward.

So far, the state has called Det. Vincent Kaaiakamanu, from Fremont County Sheriff’s Office to talk about phone use within the jail system as a June 9, 2020, phone call between Lori, when she was in jail, and Chad on the day that police were searched his property.

The prosecution also called Rexburg Police Department Detective Eric Wheeler to testify about the arrest of Chad Daybell and his demeanor when the children’s bodies were found on his property.

Wheeler was dismissed from the stand but could be called back later if needed. Rexburg Police Department Lt. Powell was called to the stand at 11:45 a.m. Court was expected to adjourn for lunch at around 12:30 a.m.

Testimony will continue into the afternoon.
