Chad Daybell’s Attorney files a motion to delay trial based on new evidence

FREEMONT COUNTY, Idaho (KMVT/KSVT)-Chad Daybell’s defense attorney John Prior, has file a motion to request more time, or that evidence he claims is new be omitted from trial, which is scheduled to start in Boise on April 1st.

According to Cases of Judicial Interest, new filings indicate that Prior believes he needs time for his experts to review findings the state has in regards to new information coming out of Arizona.

However, according to court documents the deadline for discovery was set for the end of January.

The state replied by objecting to the motion to delay the trial on February 12th.

They list several items they have in which Prior can be referring to, including an FBI report created for the Maricopa County Prosecutors Office, in relation to the charges and subsequent trial of Lori Vallow Daybell in Arizona that is slated to begin in August.

Chad Daybell is charged with first-degree murder in the deaths of his current wife’s, Lori Vallow Daybell’s two children,J.J. Vallow and Tylee Ryan, and the death of his former wife Tammy Daybell, as well as conspiracy to commit murder and grand theft by deception.
