Deadline for Kohberger to enter alibi with the court
MOSCOW, Idaho (KMVT/KSVT) — Wednesday was the deadline for Bryan Kohberger’s defense team to provide an alibi for the night of the murder of four University of Idaho students.
In a hearing on February 28, 2024, Judge John C. Judge ordered that the defense must provide an alibi for Kohberger by April 17, if Kohberger intends to use said alibi.
The 29-year-old Kohberger has been charged with the stabbing death of four University of Idaho students in November 2022 at their off-campus home in Moscow.
According to court documents, “The alibi must state the specific place or places at which the defendant claims to have been at the time of the alleged offense and the names and addresses of the witnesses upon whom he intends to rely to establish such alibi.”
According to documents filed with the court on August 2, 2023, Kohberger’s attorney argued, “Mr. Kohberger has long had a habit of going for drives alone. Often, he would go for drives at night. He did so late on November 12 and into November 13, 2022. Mr. Kohberger is not claiming to be at a specific location at a specific time; at this time there is not a specific witness to say precisely where Mr. Kohberger was at each moment of the hours between late night November 12, 2022, and early morning November 13, 2022. He was out driving during the late night and early morning hours of November 12-13, 2022.”
The prosecution argued the alibi was far too vague and Judge John C. Judge agreed.
If Kohberger does not provide a more solid alibi by Wednesday, the defense will not be able to use the alleged alibi as a defense during the trial according to Judge.
Kohberger is expected to be back in court May 14, for a change of venue hearing on a motion from the defense.
